Hon'ble Sir,

I wish to bring the folowing few lines for speedy disposal of the pending court matter, which has been lingering for over six years.

1. I own a Tata Sumo No.GJ7H 8387 which stood in my name since 29.9.97. InMay,2000 this vehicle was taken by one Harun Ahmedhusain Jargal & Rabia Ahmedhusain Jargal (Godhra Municiapl's Corporator)resident of Mohammadi Mohalla, Polan Bazar, Godhra to show the same to the parties as I wanted to sale this vehicle.. However, after taking the vehcile the same was got transferred in his own name on 16.5.2000 by forging my signature in the RTO records and also a loan of Rs.100,000/- was taken against this vehicle from Godhra Transport Co-operative Credit Society Ltd., Godhra.

2. A complaint was filed in Town Police Station, Godhra and also a criminal complaint was filed in the Court bearing No.234/2000. in Chief Court, Godhra, Panchmahals. However, inspite of attending the courts for several years the case is not disposed of. On filing the case, the culprit came to me and gave me a cheque for Rs.50,000/- and an undertaking before the notary public clearly stating that he had done this mischief . He had also undertaken to pay up the loan taken from the Godhra Transport Co-op. Credit Society Ltd. in a period of two months but nothing has been done so far. . The cheque given by him bounced and a complaint against him was filed under Negotiable Instruments Act. Inspite of several warrants issued by the Court, the culprit has notbeen arrested though he is in town and as a result the case is not being finalised. I am therefore unable to sell my caror use it on roads and is getting decayed and may become useless in course of time.

3. I had also requested for copies of transfer papers from the office of RTO under Right to Information Act but was informed that this information is not available with them.

Under the circumstances, I am left with no alternative but to approach you sir, with a request to kindly direct appropriate authorities to execute the warrant or attach his property . As is the saying, justice delayed is justice denied. In my case I have not been given justice even after six years.

I shall appreciate your early action in the matter in the interest of justice.
